Passenger Waiver

By signing this Agreement, I acknowledge that I have voluntarily chosen to participate as a passenger on a vessel operated or arranged by Soul Tides SC. I understand that boating and water-related activities involve inherent risks that cannot be completely eliminated.

I understand and voluntarily assume all risks associated with participating in this boating activity, including but not limited to: slips, trips, falls, or loss of balance; boarding or exiting the vessel; changing weather or water conditions; waves, wakes, currents, and rough water; exposure to sun, heat, wind, rain, insects, or other environmental conditions; drowning or other water-related injuries; and injuries caused by my own actions or the actions of other passengers. I voluntarily accept these risks for myself and any minor children for whom I am signing.

To the fullest extent permitted by South Carolina law, I release, waive, discharge, and hold harmless Soul Tides SC, its owners, members, employees, captains, crew, volunteers, event hosts, sponsors, affiliates, and the owners of any vessels used during this event from any claims, demands, causes of action, liabilities, damages, costs, or expenses arising out of or related to my participation, except where caused by gross negligence, recklessness, or intentional misconduct.

I agree to follow all instructions given by the captain and crew at all times. I will remain seated or otherwise follow the captain's instructions while the vessel is underway. I will not stand, move around unnecessarily, or engage in unsafe behavior while the vessel is in motion. I will only board and exit the vessel from the stern (rear) unless otherwise directed by the captain. The captain or crew will assist me when boarding and exiting. I understand that failure to follow these safety rules may result in my removal from the trip without refund.

I understand that the captain has absolute authority regarding the safe operation of the vessel. The captain may delay, shorten, reroute, or cancel the trip because of weather, mechanical issues, water conditions, emergencies, or any other safety concern; require any passenger to wear a life jacket; and refuse boarding or remove any passenger whose behavior presents a safety risk.

I understand that United States Coast Guard approved life jackets are available on board. South Carolina law requires children under 13 years of age to wear a properly fitted life jacket while aboard certain recreational vessels. I am responsible for informing the captain if I or anyone in my party requires or requests a life jacket, and I may request to wear a life jacket at any time during the trip.

I understand that boating is an outdoor activity. I may become wet from waves, rain, spray, or other water conditions. My clothing, phones, cameras, electronics, and other personal belongings may become wet or damaged, and I am solely responsible for protecting my personal property.

I understand that I will be exposed to sunlight and outdoor conditions. I accept responsibility for bringing and applying sunscreen, wearing appropriate clothing, staying hydrated, and protecting myself and any minors in my care from environmental exposure.

I certify that I am physically able to participate. In the event of an illness or emergency, I authorize the captain or crew to obtain emergency medical assistance if they believe it is necessary. I understand that I am solely responsible for any medical expenses incurred.

I agree not to board the vessel while impaired by illegal drugs or excessive alcohol. I understand that the captain may refuse boarding or terminate my participation if my behavior threatens the safety or enjoyment of others.

Soul Tides SC is not responsible for lost, stolen, or damaged personal property, including but not limited to phones, cameras, jewelry, wallets, purses, clothing, or electronic devices.

Unless I notify Soul Tides SC in writing before departure, I grant permission for photographs and videos taken during the trip to be used for promotional, advertising, and social media purposes without compensation.

I agree to indemnify and hold harmless Soul Tides SC and its owners, captains, crew, event hosts, sponsors, and affiliates from any claims, damages, or expenses arising from my own negligent or intentional actions during the trip.

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement shall be governed by and interpreted under the laws of the State of South Carolina.

I certify that I have carefully read this entire Agreement, that I fully understand its contents, that I understand I am giving up certain legal rights by signing this document, and that I sign this Agreement voluntarily and without coercion. If a participant is under 18 years of age, a parent or legal guardian signs on their behalf.
